Terms of Use

These terms are the agreement between you and StarNova for using Hearth Island. Using the app means you accept them.

1. What Hearth Island is

Hearth Island is a focus app. You start a focus session; when you finish it you earn Focus Energy (✦), which you spend to plant, build and unlock pieces of a small 3D island that grows and lives on its own. Everything runs on your iPhone, and your progress is stored on your device.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Hearth Island on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, rent, sublicense, reverse-engineer, decompile, or attempt to extract the source code of the app, except where that restriction is prohibited by law.

3. Your progress is yours

The island you build and the progress you make are yours. We claim no ownership over them and no licence to them. Because they live on your device, we could not use them even if we wanted to. We are not responsible for progress lost if you delete the app, reset the app's data, or lose the device, since we hold no copy to restore from.

4. What you agree not to do

• Interfere with the app's operation, or circumvent its purchase or entitlement checks — including the rule that Focus Energy is earned only by focusing and is never for sale.
• Reverse-engineer, tamper with, or attempt to unlock premium content without paying for it.
• Use the app in violation of any applicable law.

Hearth Island has no accounts, no feed, and no user-to-user content, so there is nothing to moderate and nothing you can publish to other people through the app.

5. Hearth Premium, purchases, and renewals

Hearth Island is free to use, and the whole focus loop — focus, earn, plant, build and grow your island — works for free. Hearth Premium opens the full premium catalog (extra plants, buildings, companion pieces and new islands as they arrive). Premium items still cost Focus Energy that you earn by focusing; money only opens the catalog, and never buys progress.

• Subscriptions (monthly and yearly) renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before it ends. Your Apple Account is charged for renewal within 24 hours of the period ending. A free trial, where offered, converts to a paid subscription unless cancelled at least 24 hours before it ends.
• Lifetime is a one-time purchase and does not renew.
• You can manage or cancel a subscription any time in iOS Settings ▸ your name ▸ Subscriptions. Deleting the app does not cancel a subscription.
• Prices are shown in the app in your local currency before you buy and may differ by region. We may change prices; a change never affects a period you have already paid for.
• Purchases restore via Restore purchases in the app.

All payments are processed by Apple. Refunds are handled by Apple, not by us — request one at reportaproblem.apple.com. Unused portions of a free trial, if one is offered, are forfeited when you buy a subscription.

6. Changes to the app

We may add, change, or remove features, and we may stop offering Hearth Island. If we discontinue the app, we will make a reasonable effort to give notice in advance. Features described as part of Premium at the time of your purchase will not be moved behind an additional charge for the period you have paid for.

7. Disclaimer

Hearth Island is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, and the Focus Shield depends on system features we do not control. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

8. Limitation of liability

To the fullest extent permitted by law, StarNova is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost progress, arising from your use of Hearth Island. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

9. Apple

Apple is not a party to these terms and has no obligation to provide support for Hearth Island. Apple is a third-party beneficiary of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

10. Termination

These terms apply until terminated. They end when you delete Hearth Island from your devices. We may suspend or end your licence if you materially breach these terms. Sections 3, 7, 8, 9 and 11 survive termination.

11. Governing law

These terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence.
